Terms and Conditions of ChronicallyKind.com for Chronically Kind LLC

Welcome to ChronicallyKind.com. These Terms and Conditions ("Terms") govern your access to and use of the ChronicallyKind.com website, ChronicallyKindLife.com website and related services. By creating an account or using our services, you agree to these Terms in full.

1. Definitions

  • “ChronicallyKind,” “ChronicallyKind.com,” “Chronically Kind LLC,” “we,” “us,” or “our” refers to the platform operator.
     

  • “User,” “you,” or “your” refers to any visitor, registered account holder, care provider, or carer using the site.
     

  • “Carer” refers to any individual registering a child or dependent to receive care.
     

  • “Care Provider” refers to a person offering childcare through our platform.
     

  • “Services” refers to any platform-provided functionality, including scheduling, messaging, booking, and account management.

2. Eligibility

You must be at least 18 years old to register for an account and use our Services. By signing up, you confirm that:

  • You are legally authorized to act on behalf of any child or dependent for whom you request services.
     

  • The information you provide is accurate and current.
     

  • You will maintain the security of your login credentials.

3. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Provide false or misleading information.
     

  • Impersonate another person or entity.
     

  • Use the Services to harm, exploit, or endanger others.
     

  • Interfere with the proper functioning of the platform.
     

We reserve the right to suspend or terminate any account that violates these Terms.

4. Account Types

There are three primary user roles:

  • Carers: Register children for care services.
     

  • Care Providers: Offer care in-home or in public spaces.
     

  • Administrators: Operate and manage the ChronicallyKind platform.

Each user role may have additional terms, waivers, and verification requirements.

5. Care Services Disclaimer

Chronically Kind LLC is a platform that connects carers with independent care providers. We do not employ, supervise, or directly manage these care providers, and they operate as independent contractors who are solely responsible for their own actions, qualifications, and compliance with applicable childcare laws and regulations.

While Chronically Kind LLC performs initial background checks on care providers through a third-party screening service, we do not guarantee the accuracy of those checks, nor do we warrant the ongoing conduct, competence, or suitability of any care provider.

Carers are solely responsible for evaluating and selecting care providers for their specific needs. Chronically Kind LLC encourages carers to exercise due diligence and to communicate directly with care providers prior to engaging services.

If you witness or suspect any form of misconduct, unprofessional behavior, or safety concerns involving a care provider, you are urged to report it immediately to Chronically Kind LLC at chronicallykind@gmail.com. We take all concerns seriously and will take appropriate action, including but not limited to investigation, retraining, or removal of the care provider from our platform.

Your safety and well-being are our top priority, and we are committed to maintaining a trusted, respectful, and secure environment for all users.

6. Release of Liability

By using the Services, you acknowledge and agree:

  • Chronically Kind LLC is not responsible for any injury, loss, damage, or misconduct that occurs during care provided by a third party.
     

  • You voluntarily assume all risks associated with receiving or providing care through our platform.
     

  • You agree to release and hold harmless Chronically Kind LLC, its employees, volunteers, agents, and affiliates from any claims or liabilities arising out of or related to your use of the Services.
     

Carers may be required to sign a separate Waiver and Consent Form prior to engaging services.

7. Payment and Fees

Payments for services may be facilitated through third-party platforms (e.g., Stripe, PayPal). You agree to:

  • Pay all applicable fees as disclosed at the time of booking.
     

  • Not attempt to circumvent the platform by arranging off-platform payments.
     

Chronically Kind LLC may charge service fees and reserves the right to change pricing with prior notice.

8. Cancellations and Refunds

Refund and cancellation policies are outlined separately and available to view during your booking process. Different services may have differences in refund and cancellation, specifically the Virtual Meet and Greet service versus a Care booking.


It is your responsibility to review these terms before booking a service.

9. Third-Party Services

Chronically Kind LLC may use third-party tools (e.g., analytics, email platforms, background checks). Your use of those services is subject to their respective terms and privacy policies.

10. Intellectual Property

All content on ChronicallyKind.com, including text, graphics, logos, and software, is owned by or licensed to Chronically Kind LLC. You may not reproduce or distribute content without written permission.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time for violations of these Terms or any applicable law.

13. Dispute Resolution

Any dispute arising from these Terms will be governed by the laws of the State of Florida, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Flagler, Florida.

14. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top. Continued use of the Services after changes constitutes your acceptance.
